THE CONTESTED HEARING
If the judge granted them a temporary stalking order at the ex parte hearing, the judge will automatically set a contested hearing date. At the contested hearing, both you and the petitioner will have an opportunity to present evidence and tell your side of the story. They have the burden of proving that they meet the requirements (elements) for a stalking protective order. At the end of the hearing, the judge will either dismiss the SPO or grant them a permanent SPO.
